Protection Review and Trial Listing Hearings

Starting in November 2020, the President of the Children's Court of Western Australia will hear all trial listings for protection and care matters, and conduct review hearings for some matters which already have trial dates.

The reason for this is that there is an unacceptably high number of protection trials which do not proceed on their allocated date.  This is most undesirable for the affected children and parties, and wastes court and other resources.

The President will conduct trial listing and review hearings once a month in court room 4, starting on 11 November 2020.

Matters which are ready to go to trial, will be adjourned to the President's list from the general protection list or pre hearing conference.

Review matters will be selected by the President, and you will be notified that the matter is being brought before the President.

Listings will start at 9:30am, 11:30am and 2:15pm. Each time slot will have six cases. Each case will be given approximately 20 minutes.

You must arrive on time for your hearing.

All parties are required to attend the hearing, unless you have been given permission not to by the President.

If you have a lawyer, the lawyer has to attend, and know about the matter. You still should continue talks to limit the issues still in dispute before the hearing.

The President requires that all parties:

  • complete a Trial Listing Callover Certificate
  • lodge it with the registry 3 working days prior to the hearing, and
  • a copy of the certificate must also be served (given) to the Department of Communities and all the other parties, including the child representative that has been appointed.

If you have not filed any documents prior to the hearing and, it is decided at the hearing that the trial will go ahead, orders may be made for the filing of documents and evidence in support of your case.

The President will make any other necessary orders at the hearing.
