Practice Direction 4 of 2006 - Early Listings of Applications before the President

This Practice Directions will take effect as from 21 June 2006.

Principles and considerations

For some time now a significant percentage of applications listed before the President on an "early listing" basis have not been ready to proceed and be determined on the early listed date.

It is undesirable for many good reasons and there is no point having matters listed early if they will not be ready to proceed on the early listed date.

At present there is a process for applications for an early listing. That process includes the completion of a form by the applicant and which covers all types of applications that go before the President and Magistrates.

After consultation I have decided that a separate process and form is to be used for the early listing of applications before the President. This new process and form only applies to the early listing of applications before the President.

The new application form for early listing applications before the President is attached.

When an application is received on this form by the Registry it will be forwarded to the President's Associate. The President's Associate will then liaise with the parties and fix a date and time for the application to be heard and in turn inform the parties and the Registry Listings Officer of it.

The Registry Listings Officer can then note the listing and prepare and send off any necessary bring up order.

In relation to all applications for an early listing before a Magistrate the current process is to continue without any change subject to some minor changes to the form. A copy of the new form to be used for early listings before a Magistrate is also attached.
